The internet is full of the information about the Kentucky case, the story develops rapidly and more and more new facts appear every day. Kentucky legislation allows to the Government officials to confiscate the domain names of not only American, but the international companies accepting players from the USA.

But as the previous initiatives of the USA Government don’t work properly online casinos aren’t going to hurry up. But the court decides to give one month to the online gambling sites to block Kentucky gamblers, in other case all the domain names will be confiscated, some leaders of the industry like has Microgaming casino agreed with the new legislation, but some other companies refuse to do it.

In that way now we can see that the situation on the American casino gambling market is very complicated, because some online casinos have decided to leave the US market preferring don’t come up against the American Government, the next part of the companies have made special lists dividing all the states and players living there into “legal” and “illegal” (so they will accept or refuse you depending the geographical position) and at least the others have decided to operate at the same mode and protested against the dubious law.

They proclaim that this Kentucky legislation touches not only the internet gambling industry, but certainly the field of the domain names protocol and it’s difficult not to agree with it. The Interactive Media Entertainment & Gaming Association (IMEGA) has made an official protest against it. IMEGA supposes that all the installations of the geo-blocking technology at the gambling sites (all the casinos which wish to operate on the US market have to block carefully all the people from the banned states) are the violation of the casinos’ rights and this organization is going to stand against it.

IMEGA will not only to blame the Government, but will fight for the rights of the free online casino gambling sites and the next step will be the appeal to the next higher court.

The reasons of the appealing are the following: IMEGA considers that the decision of the Judge Wingate violates the guaranteed rights of the American constitution.

This ban will not distinguish the casinos from each others, it will touch upon all of them, both American and foreign ones for the accepting Kentucky gamblers. This legislation is absolutely new and unexampled and IMEGA is absolutely sure that Justice and Kentucky officials simply have no jurisdiction to seize the international domain names.

New law not only violates the constitutional rights of the American gamers, but also violates existing laws within Kentucky State. The American Government has no jurisdiction over the offshore online casinos and foreign internet gambling sites, that’s why all the threats of closing the domain name just can’t be realized.

IMEGA declares that the real aim of the new legislation is not simple getting things put in order, but the attack to the internet gambling market. According to the experience of the other countries the prohibition of the gambling activity can’t lead to the positive results and the aim of this action is to eliminate the competition between the different gambling sites and bring more money into state budget through the penalties from the side if the internet sites which have been previously operated on the Kentucky market.

Today no one is able to say for sure if the IMEGA’s position brings to the online casinos some positive results.
